1. Introduction
Welcome to the Shibari Healing Collective Affiliate Program (the "Program"). By participating in our Program, you agree to the terms and conditions set forth in this document (the “Terms of Service”).
2. Eligibility and Enrollment
To enroll in the Program, you must:
Be at least 18 years of age at the time of signing up.
Complete the affiliate application and receive approval from our team. Approval is at our discretion and is based on factors including suitability for our brand and alignment with our values.
Upon signing up, you will gain access to your affiliate dashboard where you can obtain your unique discount code, access marketing materials, and track your commissions.
3. Commission Structure
As an affiliate, you will earn a 10% commission on sales of eligible products and services made through your unique affiliate link or discount code. Commissions are calculated on the net value of the sale (excluding taxes, shipping, and returns).
4. Payment of Commissions
Commissions are paid monthly via PayPal, provided your commission balance reaches a minimum payout threshold of $20. You are responsible for any taxes associated with commission fees.
5. Affiliate Obligations
As an affiliate, you agree to:
Conduct promotional activities ethically and in compliance with all applicable laws and regulations.
Use our marketing and promotional materials appropriately.
Not engage in misleading, deceptive, or harmful practices.
Maintain confidentiality regarding your affiliate link and discount code.
6. Intellectual Property
You are granted a non-exclusive, non-transferable, revocable right to use our brand name, logos, and promotional materials solely for promoting our products and services under these Terms of Service.
7. Term and Termination
This Agreement begins upon your acceptance into the Program and continues until terminated by either party. You may terminate your participation in the Program at any time via your affiliate dashboard. We may terminate this Agreement at any time, with or without cause, by providing written notice.
8. Modifications
We may modify any terms and conditions of this Agreement at our sole discretion. Modifications may include changes in commission rates, payment procedures, and Program rules.
9. Limitation of Liability
We are not liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising in connection with this Agreement or the Program.
10. Indemnification
You agree to indemnify and hold harmless Shibari Healing Collective and its employees, representatives, and agents, from liabilities, damages, fines, judgments, claims, costs, and expenses, including attorney fees, related to your breach of this Agreement or participation in the Program.
11. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Maine, USA.
12. Acceptance
By participating in the Shibari Healing Collective Affiliate Program, you acknowledge that you have read these terms and agree to be bound by them.
